Terms of Service

These Terms govern access to and use of SellPeak. SellPeak is currently available only on a limited private-beta basis while broader platform access is under review.

Independent application

SellPeak is independently developed and operated. Etsy, Inc. and its affiliates are not the application developer and do not provide the SellPeak service.

Eligibility and authorized accounts

You may connect only accounts, shops, and data that you own or are authorized to access. You are responsible for maintaining the security of your SellPeak account and for activity performed through it.

Etsy authorization

SellPeak uses Etsy's approved OAuth authorization process for private Etsy data. SellPeak will not request your Etsy password. Access is limited to the permissions granted through OAuth and may be revoked through applicable Etsy account controls.

Permitted use

You agree to use SellPeak lawfully and consistently with applicable platform rules, intellectual-property rights, prohibited-items policies, and these Terms. You may not use SellPeak to bypass platform access controls, obtain data you are not authorized to access, interfere with the service, or misuse another person's account or data.

Data sources and analytics

SellPeak may display authorized shop information, calculated metrics, derived signals, estimates, and AI-assisted analysis. Calculations and recommendations are provided as decision-support tools and may be incomplete or inaccurate. You remain responsible for business, pricing, tax, inventory, advertising, and other decisions.

No screen scraping of Etsy data

SellPeak is designed to retrieve and post Etsy data through approved Etsy API methods and does not sidestep the API through screen scraping.

Service availability and changes

Features may be added, changed, suspended, or removed as SellPeak develops and as third-party APIs, permissions, technical requirements, or platform policies change. Private-beta access may be limited or ended at any time.

Third-party services

SellPeak depends on third-party platforms and service providers. SellPeak is not responsible for the availability, policies, acts, or omissions of third parties, including Etsy.

No guarantee of business results

SellPeak does not guarantee sales, rankings, traffic, profitability, marketplace performance, or any specific business outcome. Historical or estimated information does not guarantee future results.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELLPEAK IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

ETSY-SPECIFIC DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY SELLPEAK (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

Subscriptions, billing, and cancellation

Paid SellPeak plans are recurring subscriptions billed through Stripe. Prices and billing intervals are shown before checkout. Plan upgrades may take effect immediately with applicable prorated charges or credits. Downgrades and cancellations may take effect at the end of the current paid billing period depending on the option selected in Stripe's customer portal.

Refunds

Except where required by law, fees already charged are generally non-refundable. If a duplicate charge, technical billing error, or other exceptional circumstance occurs, contact SellPeak support so the charge can be reviewed.

Account deletion

You may request deletion through SellPeak's account settings. Deleting an account removes SellPeak-held account and synced-shop data as described in the Privacy Policy, subject to limited records that may need to be retained for legal, security, fraud-prevention, or financial-recordkeeping purposes.
